중국 해양환경관리정책의 변화와 시사점

Abstract

중국 해양환경정책의 형성은 국제협약과 궤를 같이한다. 국제사회가 1970년대 이후 형성한 일련의 규범은 국내법으로 수용되었고, 중국 국내 기준보다 엄격한 협약 기준은 국내법에 우선하여 적용되고 있다는 점에서 해양환경을 위한 국가의 실천의지는 확보되고 있다고 평가할 수 있다. 그러나 중국의 환경관리체제는 중앙과 지방정부 그리고 부서간 단계화된 분층구조로 인해 비효율성을 야기한다. 또한 중앙정부의 거시적 해양환경정책과는 달리 실제로 관리의 주체가 되는 지방정부의 경제성장 정책이 우선시 되면서 지방정부의 해양환경보호 정책에 대한 통제력이 약화되고 있다. 해양환경정책 수립과 집행 과정에서의 분권화와 제3자의 참여 제한, 중앙정부의 정책과 지방정부의 경제성장 정책 간의 갈등으로 인한 체제적 모순에도 불구하고, 중국의 해양환경관리 시스템 구축 및 제도 개선에 대한 의지는 긍정적 평가의 일면을 가지고 있다. 특히, 일부 해역에서의 EBM 개념 관리에 대한 긍정적 도입, 해역의 특성과 기능에 따른 구획과 중점관리 정책은 국제사회의 논의를 반영하고 있다고 볼 수 있다. 동시에 해양환경법령에 대한 제정 및 수정에 대한 계획이 장기적으로 제시하고 이를 실행하면서 법제에 대한 사회경제적 수요와 현실을 장기적으로 관망한다는 점은 우리에게 시사하는 바가 크다.

The recent formation of marine environment policy in China has followed the orientation of international conventions. Since the 1970s, various marine protection rules consented by the international society have been affirmatively reflected in the Chinese legislation, and some international rules even more stringent than the domestic ones have been respected above the domestic laws and regulations. This new movement illustrates that the Chinese government has a strong will to endorse the spirit of marine environment protection. The marine environment management plans in China, however, are often tempered by the hierarchical decentralized governance relationship between central and local governments. Regardless of the farsighted policies of the central government, the plans of the central government on local marine protection policy have turned sour because most of local governments which play an imminent role in policy implementation put a higher priority on the local economic development. The Chinese marine protection policies confront with nontrivial obstacles such as systemic inconsistencies, decentralized policy making processes, restriction on third-party participation, and discrepancies between central and local government policies. Despite of these huddles, China's solemn pledge on marine environment protection and management would be worth international attention. In particular, China advocate marine environment policies sanctioned by international community by implementing eco-system based management (EBM) and functionality based marine area management. In addition, it is worth noting that the Chinese government recognizes strong socioeconomic demands and urgent needs of advanced marine legislation systems, puts forward long-term plans on establishment and modification of the marine laws, and carries out the plans accordingly.
