중국의 주요 해양정책에 관한 연구 동향 분석

Abstract

중국의 최근 해양을 둘러싼 정책 혹은 법적 해석의 주류는 ‘해양안전’을 중심으로 형성되었다고 해도 과언이 아니다. 이러한 기조는 중국의 관할해역 범위 뿐 아니라, 해양활동의 대양으로의 확대와 해양공간 활용의 극대화, 국가관할권 내외측에서의 소위 ‘해양권익’ 확보를 위한 거시적 해양정책과 연계되어 일관되게 추진되었다는 특징이 있다. 본문의 분석 대상이 된 최근 2년 동안 발표된 중국 학계의 해양정책에 관한 논문 역시 이러한 틀에서 자유롭지 못하다. 학술적 측면에서는 중국 정부의 ‘정치적’ 의도가 강하게 내재되었다는 점, 이로 인한 이론적 분석이 상당부분 선행 도출된 ‘결론’의 근거를 형성하는데 그치고 있다는 점이 아쉽다. 다만, 중국의 국제규범에 대한 해석이 최근 중국의 국제적 위상만큼이나 점진적 명확성을 찾아가고 있다는 점, 중국 관할해역 내 해양자원 이용과 개발 등에 대한 객관적 성찰이 꾸준히 제기되고 있다는 점은 중국의 해양정책이 여전히 개선의 틀을 유지하고 있다는 점에서 긍정적이다.

The key issues in terms of oceans law and policy in China, recently, are mostly focused on maritime security. The maritime security has been consistently connected into the other ocean affairs including delimitation of maritime boundaries, expansion of activities into the open oceans, marine spatial planning, and exercising rights of coastal States within and beyond national waters. This paper confirms that academic interests shown through publications in the last two years in China reflect such trend of ocean policy. The most of academic works reviewed in this paper, indeed, aim to support government policy, so that conclusions of the publications could be subjective. However, there is potential of improvement in political analysis of Chinese ocean policy because scholars have recently attempted to interpret international rules objectively, and argued that more accurate analysis of exploration and exploitation of marine resources within national jurisdiction shall be conducted.
