심해저 광물자원 개발시 해양환경보호를 위한 지역환경관리계획의 규범화 가능성에 대한 연구

Abstract

지역환경관리계획은 심해저 활동으로부터 야기될 수 있는 유해한 효과로부터 해양환경을 효과적으로 보장하기 위한 하나의 방법으로 국제해저기구에서 논의되고 있다. 해양환경을 보호하기 위해 독일과 네덜란드는 지역환경관리계획의 수립, 승인 및 검토에 관한 절차 제안서를 해저기구 제26회기에서 공식의제로 제안했다. 독일 등이 제안한 의제의 핵심이슈는 REMP의 수립을 위해 전문가위원회를 구성하고 이들이 지역환경관리계획을 만들도록 하자는 것이다. REMP수립의 핵심이슈는 REMP가 규범적(의무적)인가 또는 해저기구의 해양환경보호를 위한 정책수단인가 하는 것이다. 이러한 점을 검토하기 위해 본 논문에서는 해저기구의 전략계획과 상위실행계획에서 정의한 REMP의 유형을 살펴봄과 동시에 법률기술위원회의 기능과의 중첩성 여부와 함께 해양환경보호를 위한 권한문제와 기타 법적 및 재정적 문제를 살펴보고자 한다.

The Regional Environmental Management Plan (REMP) is being discussed by the ISA as a way to ensure the effective protection of the marine environment from the harmful effects that may arise from deep sea activities. To protect the marine environment, Germany and the Netherlands proposed “Procedure for the development, approval and review of regional environmental management plans” as the official agenda in the 26th session of the ISA. The key issue of the proposed agenda proposed by Germany is to form an expert committee for the development of REMP and to have them develop a regional environmental management plan. The key issue of the REMP development discussion is whether REMP is the regulatory or is it one of the policy tools for the protection of the marine environment by the ISA. In order to review this, I will look at the types of REMP defined in the Strategic Plan and High-Level Action Plans of the ISA. And I examined whether there is no overlap of the functions of the Legal and Technical Commission, which has jurisdiction for the protection of the marine environment, and other legal and financial issues.
