해양오염퇴적물 관리체계 선진화를 위한 법제 개선방안

Abstract

해양오염퇴적물 정화·복원 사업이 필수적이고, 현재 시행되고 있음에도 불구하고 이에 대한 근거법령이 미비한 실정이다. ｢해양환경관리법｣은 제18조에서 오염된 퇴적물의 수거만 다루고 있기 때문에, 수거 이외 다양한 정화기술을 정화사업 현장에서 사용하기에 법적 근거가 마련되지 아니하여 시급한 정비가 필요하다. 또한 해양오염퇴적물을 폐기물로 취급함에 따라 자원의 효율적 이용을 저해하고, 무분별한 매립 또는 투기로 인한 환경오염의 우려도 있다. 본 논문에서는 해양오염퇴적물 정화·복원 관련 현행법제, 사업현황 및 과학·기술적 사항을 검토하고, 해양의 저서생물 및 생태계 그리고 인간의 건강에 영향을 미칠 수 있는 해양오염퇴적물의 정화, 수거, 처리 및 처분 방안을 마련하기 위해 필요한 국내 관련 법제의 개선안을 제시하고자 한다. 연구결과, 우선 오염퇴적물에 관한 규정들이 개별 법률에 산재되어 있어 실질적으로 이를 관리하는 데 어려움이 있다고 여겨지므로 별도의 법률을 제정하는 것이 타당하다고 여겨진다. 또한 법률에 해양오염퇴적물에 대하여 개념 정의를 할 필요가 있고, 해양오염퇴적물의 구체적인 정화기준 및 방법을 마련해야 할 것이다. 한편 해양오염퇴적물의 수거·처리·처분 방법을 규정함에 있어서는 재활용, 매립, 고립처분, 해양배출 등으로 단계별로 구분하여 체계적으로 이를 관리하여야 할 것이고, 기존 ‘퇴적오염물질수거업’ 이외에 ‘해양오염퇴적물처리업’을 신설하여 운영하는 것이 타당할 것으로 사료된다.

Remediation of contaminated marine sediments is going to essential issue in Korea, however domestic legislative system could be required to set up advanced management system. In the “Marine Environment Management Act”, Article 18 covers only remove of contaminated marine sediments, whereas treatment followed by environmental dredging, monitored natural recovery, in-situ capping and other remediation methods were not defined in the Act. Thus various useful methods were not widely used in Korea. 1) New legislation Act is needed to deal with remediation of contaminated marine sediments, 2) definition of terms such as “contaminated marine sediments” in the Act is also required, and 3) domestic remediation standards and methods should be provided in the new Act were suggested based on this research results.
